These Terms of Use ("Terms") govern your access to and use of ATELITH for Firms (the architecture project management web and iOS/iPad app) and ATELITH ARE Study (the iOS study companion for the Architect Registration Examination), together with atelith.com and any related services (collectively, the "Service"). The Service is operated by Hatch Media LLC ("ATELITH", "we", "us", "our").
By creating an account, signing in, downloading or installing one of our apps, starting a free trial, or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
These Terms work alongside our Privacy Policy, which explains how we handle your data.
You must be at least 16 years old to use the Service, and at least 18 years old (or the age of majority in your jurisdiction) to enter into a subscription. By using the Service you represent that you meet these requirements.
If you're using the Service on behalf of a firm or organization, you represent that you have authority to bind that entity to these Terms.
To use most features of the Service, you'll create an account or sign in with Apple. You are responsible for:
We may suspend or terminate an account at any time if we have a good-faith reason to believe these Terms have been violated, or to protect the Service or other users.
The ARE Study app is offered as an auto-renewable subscription billed through Apple's App Store.
By starting a free trial or subscription you authorize Apple to charge your Apple ID per the terms above. All payment processing for the ARE Study app is handled by Apple. We never receive your card details.
The Firms product is billed monthly or annually through Stripe. Pricing, included quotas, and free trial terms are listed on our pricing page and may change for new subscribers; existing subscribers will be notified before any change affects them.
Subscriptions auto-renew unless cancelled before the renewal date. You can cancel anytime via the Account section of the web app or by emailing us. Cancellation takes effect at the end of the current billing period.
Refunds for the Firms product are handled case-by-case. Email contact@atelith.com within 14 days of a charge if you have an issue.

The study content in the ARE Study app — flashcards, practice questions, mock exams, Field Guide, and AIA reference summaries — is licensed for your personal study only. You may not distribute, resell, or share account credentials.
Your content stays yours. For the Firms product, you retain ownership of all project content you create or upload — names, schedules, photos, punch list entries, observations, fee data. You grant us only the rights necessary to host, display, and process that content as part of operating the Service.
Our content stays ours. The Service itself — software, designs, text, study content, exam questions, Field Guide entries, brand marks, illustrations — is owned by ATELITH or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purposes during your active subscription.
Unofficial study aid. ATELITH ARE Study is an unofficial study aid produced by ATELITH. It is not affiliated with, endorsed by, or sponsored by:
"ARE", "Architect Registration Examination", "NCARB", "AIA", and "AIA Contract Documents" are trademarks of their respective owners. References to AIA documents (e.g., A201, B101, G701) are summaries for educational discussion only, not authoritative reproductions, and are not a substitute for the actual documents.
No guarantee of exam outcomes. Using the ARE Study app does not guarantee that you will pass any division of the ARE. Exam content, format, and weighting are determined by NCARB and change over time. Our content is our best effort to summarize the principles and reference material commonly tested, but it may be incomplete, outdated, or wrong on specific points.
Not professional advice. Content in the app — including questions, explanations, and Field Guide summaries — is for educational purposes only and does not constitute legal, architectural, engineering, financial, or other professional advice. Do not rely on it for real-world professional decisions. Always consult licensed professionals and current authoritative sources.
You verify your own work. Code references, contract document references, and similar regulatory content change frequently. You are responsible for verifying any application of the material to actual practice using current official sources.
Some jurisdictions don't allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you. Where required by law, our liability will be limited to the greatest extent permitted.
You agree to defend, indemnify, and hold harmless ATELITH and Hatch Media LLC and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any rights of another, or (d) your content uploaded to the Service.
You may stop using the Service at any time. To cancel a subscription, see Section 4 (ARE Study) or Section 5 (Firms).
We may suspend or terminate your access to the Service at any time, with or without notice, if: you violate these Terms; we're required by law; or we discontinue the Service (or any portion of it).
Sections that by their nature should survive termination — including Content Ownership, Disclaimers, Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law — will survive.
If we make material changes to these Terms, we'll notify you by email or by an in-app notice at least 30 days before the change takes effect. Continuing to use the Service after that time means you accept the updated Terms.
Minor changes (typo fixes, clarifications, restructuring) will be reflected in the "Last Updated" date at the top of this page.
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute arising out of or related to the Service or these Terms will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.
If you're a consumer in the EU or UK, this section doesn't deprive you of the mandatory consumer protections of your home jurisdiction.
